Article 1: Offer validity
The present Terms and Conditions of Sales apply to all sales conducted by the means of Internet site http://www.esotericjewels.com. These offers apply to private individuals and professionals, and are valid in Metropolitan France and overseas. All items are offered subject to availability at the time of receipt of the order.

Article 2: Products
Gold jewellery sold on the website http://www.esotericjewels.com is in 750/1000 gold (18 carat or 75.0% gold), produced using the State certifying hallmark. (Items containing gold and weighing more than 3 grams are engraved with two hallmarks: the producer's hallmark and State hallmark; weighing less than 3 grams are only engraved with the producer's hallmark).
Silver jewellery sold on the website http://www.esotericjewels.com is in 925 sterling silver or 800/100 silver (92.5% pure silver and 80% pure silver), produced using the State certifying hallmark. (Items containing silver and weighing more than 30 grams are engraved with two hallmarks: the producer's hallmark and State hallmark; weighing less than 30 grams are only engraved with the producer's hallmark).
The pictures and texts, reproducing and illustrating products, are provided for informational purposes and are non-binding. Items are enlarged between 1 and 10 times. While our website is as accurate as possible, we cannot accept responsibility for any inaccuracies or errors in the pictures or texts.

Article 3: Prices and Payments
All prices are inclusive of VAT, and exclude charges for postage and packaging.
We reserve the right to change the prices of goods without prior notice. Those who access the site outside of France are responsible for compliance with their local laws and taxes.

Article 4: Safety and Security
To securely receive your payments over the Internet we use Secure Sockets Layer (SSL) encryption technology.

Article 5: Postage and Packaging
Buyers will assume all postage and packaging costs. Postage and packaging costs may vary according to the mode of transport and destination country.

Article 6: Delivery

We will arrange for products to be delivered to the address for delivery indicated in your order.
Delivery period includes preparation time and shipping time.
Goods will normally be delivered in Metropolitan France within 3 working days of acceptance of order. Any delivery dates are merely estimates and are not guaranteed, and Michel Comte shall not be responsible or liable for any late delivery.
Please note that if you wish to pay by cheque, the order will be dispatched after the cheque has cleared.

Article 7: Payment The total price of the order is payable:
1/ by bank card (VISA, Eurocard/Mastercard, American Express), payment must be received in full before your order can be accepted (according to the price of your order, Michel Comte can ask for your bank account details by e-mail).
2/ by bank transfer, payment must be received in full before your order can be accepted.
3/ by cheque, payment must be received in full before your order can be accepted, or above a certain amount within 3 monthly installments without charge.
4/ by PayPal payment must be received in full before your order can be accepted.

Article 8: Cancellation and Return
Buyers are entitled to cancel an order within 7 working days of receipt of the goods. You must return the goods in their original packaging and condition, along with the invoice and bank account details. The shipment must be made by "Declared value for carriage". The postage and return costs are chargeable to the buyer.

Goods that have been modified at the request of the buyer annot be returned to the seller: they are non-refundable, non-exchangeable. Example: "a piece of jewellery, an item for baby that has been personalised with an engraving, a piece of jewellery or an object on which the buyer asked for a modification or improvement"...etc. as well as for all special orders.

Article 9: Risk and Title Ownership of the products will only pass to you after full payment of all sums due in respect of the products are received, whatever the delivery date might be. All risks associated with the goods including loss, breakage and damage and all other risks shall pass to you on delivery.

Article 10: Liability
Michel Comte is not liable for any loss as a result of failure to deliver caused by or the consequence of being out of stock, unavailability of the product, force majeure, disturbance, total or partial strike of postal services and transpotation/communication means, flooding or fire.

Article 11: Governing Laws and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with French laws, and the parties agree to submit to the exclusive jurisdiction of the courts under which the seller is situated.

Article 12: Personal Data
Personal data will not be passed onto any third parties. All personal data will remain confidential and is held for the purpose of performing the services intended on this site.
In accordance with French law on data protection (Loi Informatique et Liberté no. 78-17 of 6 January 1978), the buyer has the right to access, oppose, rectify and remove any personal data relating to him. To do so, just send us your request by mail:

Article 13: Condition
The present Terms and Conditions and prices shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer. Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyers acceptance of these Terms and Conditions..

Article 14: Commission Work
Commission work refers to when the buyer provides his GOLD to make a piece of jewellery or item of his choice: the buyer only pays for the craftsman work. Michel Comte workshop only accepts 18 karat gold minimum (750/1000).
The gold weight returned is 10% inferior to the old gold provided (example: 10 gr. old gold. Weight returned to the buyer 9 gr.).
This service is only available in France. Any request outside of France will be refused.
The buyer will be asked by e-mail a copy of his ID card or passport, along with a full valid address. The buyer shall accept that Michel Comte discloses this information at the request of official institutions (customs, Gendarmerie, guarantee...).
On receipt of the client's gold, a picture will be taken to keep track of the old gold and it will be archived with a copy of the ID card or passport.
Michel Comte will inspect the metal received and will validate the exact 750/1000 gold weight to the client via e-mail, only after the client's validation and by e-mail, Michel Comte will proceed to the metal casting.
Only the indications on the material, gold fineness, information on stones, and the weight indicated on this e-mail will be taken into account in the event of litigation with the client.
If the client sends metal with a fineness inferior to 750 or any other metal, Michel Comte will send the metal back when dispatching the order. If the client cancels the transaction, all the metal will be sent back at his expense by declared value (the parcel will be sent once payment by the client has been received).
